Can I Keep the Repair Money if My Car is a Total Loss?

I was in an accident and made an insurance claim. The insurance company gave me money for the repairs, but they subtracted the deductible. Now they say my car is a total loss. Can I keep the repair money, or will they take it out of what they pay me for the car?

You cannot be reimbursed for more than the actual cash value of the car, minus the deductible, plus registration fees, taxes, and any other applicable state-mandated fees.

This doesn’t make sense. If the vehicle is totaled, they pay you its value. If it’s not totaled, they cover the repair costs. It can’t be both.

The original poster (OP) first received a payment covering the estimate, minus the deductible. However, once the vehicle was in the shop, it was deemed a total loss. Now, the OP will receive the actual cash value of the vehicle, minus the amount already paid for the estimate.
